TheraWest Physical Therapy respects your privacy and is committed to protecting the personal and health information you share with us, whether you reach out through our website, call one of our clinics, or come to us as a patient. TheraWest is a healthcare provider under the Health Insurance Portability and Accountability Act (HIPAA), so this notice explains our legal duties and your rights regarding your protected health information (PHI), along with how we handle the general information we collect when you contact us online.

Information We Collect

When you submit an inquiry through our website or contact us by phone, we may collect your name, phone number, email address, and any details you share about your condition. If you become a patient, we also collect and maintain protected health information (PHI) as part of your care, including your medical history, treatment notes, diagnoses, progress reports, and insurance or billing information. This information comes to us from you directly, from referring physicians, and from insurance companies as needed to coordinate your care and payment.

How We Use and Share Your Information

We use your information to contact you about your inquiry, schedule appointments, and provide information about our services. As your healthcare provider, we also use and share your PHI, without needing separate permission from you, for:

• Treatment: coordinating your care among our therapists, consulting with your physician or other providers involved in your care, and making referrals when appropriate.

• Payment: billing your insurance, verifying coverage, and processing claims or payments for the care you receive.

• Healthcare operations: quality review, staff training, scheduling, and other activities needed to run our practice.

Other Uses and Disclosures Permitted or Required by Law

In limited situations, the law allows or requires us to share your information without your authorization, such as for public health reporting, in response to a court order or subpoena, to avert a serious threat to health or safety, for workers’ compensation claims, or as otherwise required by state or federal law.

Uses That Require Your Written Authorization, and Marketing Communications

Any use or disclosure of your PHI beyond treatment, payment, healthcare operations, or the legally permitted situations described above requires your written authorization, which you may revoke at any time.

By submitting your information to us, you agree that we may contact you by phone, text message, or email about your inquiry, appointment reminders, and general information about our services. Message and data rates may apply, and you can opt out of these communications at any time. Separately, if we ever wanted to use your information for marketing unrelated to your care, HIPAA requires us to get your written authorization first. We do not sell your personal or health information to third parties.

Your Rights Regarding Your Health Information

You have the right to:

• Inspect and receive a copy of your health records, in paper or electronic form.

• Request a correction to your health information if you believe it is incomplete or inaccurate.

• Receive a list of certain disclosures we have made of your information.

• Request restrictions on how we use or share your information, or ask that we communicate with you in a specific way or at a different location.

• Receive a paper copy of this notice at any time, even if you agreed to receive it electronically.

• File a complaint with us or with the U.S. Department of Health and Human Services if you believe your privacy rights have been violated, without fear of retaliation.

Our Responsibilities

TheraWest Physical Therapy is required by law to maintain the privacy of your health information, provide you with this notice describing our legal duties and privacy practices, and follow the terms currently in effect. We reserve the right to change this notice and to apply the revised terms to health information we already have as well as information we receive in the future. If we make a material change, we will update this notice and post the current version at our clinics and on our website.

Data Protection and Security

We do not sell or share your personal or health information with third parties for marketing purposes. Your information, whether submitted through our website or maintained as part of your medical record, is stored securely, and access is limited to staff who need it to provide or bill for your care, consistent with HIPAA’s security requirements.

Changes to This Notice and How to File a Complaint

We may update this notice from time to time. The current version will always be available at our clinics and on our website, and you may request a copy at any time.

If you believe your privacy rights have been violated, you can file a complaint with TheraWest’s Privacy Officer using the contact information below, or with the U.S. Department of Health and Human Services, Office for Civil Rights, by mail at 200 Independence Avenue SW, Washington, D.C. 20201, by phone at 1-800-368-1019, or online at www.hhs.gov/ocr/complaints. We will not retaliate against you for filing a complaint.
